BOARD OF ZONING APPEALS
#1976 LOUCKS RESIDENCE 2979 BROXTON ROAD:

Public Hearing on the request of Christopher Loucks, 2979 Broxton Road, to the Board of Zoning Appeals for a variance to the fence location and fence height on a corner lot. The applicant proposes to install a 4 foot tall black aluminum ornamental fence and a 6 foot tall board-on-board wood fence on this corner lot at Broxton and South Woodland Roads. The ornamental aluminum fence is proposed parallel to and located 40 feet off the South Woodland Road sidewalk. Code requires that fences located in corner side yards not extend in front of the setback line of the principal building on the adjacent lot. The adjacent louse on South Woodland Road is set back 75 feet. A 6 foot tall wood board-on-board fence is also proposed on the eastern, or rear, property line. Code allows a fence height in a corner side yard of 3 feet tall. The ornamental aluminum fence is proposed to be screened with new seagreen juniper bushes while existing landscaping is proposed to screen the board-on-board wood fence from street view.

Public Hearing on the request of ONeal Furr, Gensler Architects, on behalf of McGlinchey Stafford, 3401 Tuttle Road, to the Board of Zoning Appeals for a variance to the letter size of a primary sign. The applicant proposes a primary wall sign on the Warrensville Center Road façade of the C-1 building in the Van Aken District. The proposed sign is proposed with 26 inch high letters and to be located on the third floor wall of the building facing Warrensville Center Road. The newly adopted Local Sign District for Tenant Signage in the Van Aken District limits office tenant signs to 15 inch tall letters. This is McGlinchey Staffords only sign on the building.

#1973 WENDYS RESTAURANT 3516 WARRENSVILLE CENTER ROAD:
Public Hearing on the request of Irma Reiner, Linear Architects, representing Jim Moll, MUY! Hamburgers, 3516 Warrensville Center Road, to the Board of Zoning Appeals and City Planning Commission for a Conditional Use Permit, site plan review, variances, and resubdivision of land in order to construct a new Wendys restaurant at the corner of Warrensville Center Road and Chagrin Boulevard. A Conditional Use Permit is required for the drive-through, which includes 2 stacking lanes and access to Warrensville Center Road. Site plan review is required to demolish the existing building and construct a new building on this corner lot. Variances are requested to the rear buffer, shade trees, front yard maximum building setback, and the number of signs requirements. Commercial Mixed Use district design standard variances are requested and include variances to parking lot frontage, percentage of clear first floor windows, arrangement of public space, and street context and franchise architecture. Resubdivision of land is required to combine parcel numbers 736-29-035,036 and 044 into one parcel including combining the vacated right-of-way at the corner of Chagrin Boulevard and Warrensville Center Road. The Conditional Use Permit requires Council confirmation.
#1974 OBRIEN RESIDENCE 18205 SHELBURNE ROAD:

Public Hearing on the request of Michael Caito, Payne and Payne Buildings, Inc., representing Robert and Ann OBrien, 18205 Shelburne Road, to the Board of Zoning Appeals and City Planning Commission for site plan review and parking and landscape variances for a new single-family house. The applicant proposes to construct a 4 bedroom house on this vacant lot, with a 3 car attached garage at the rear of the house. The house will have a first floor master bedroom, front porch, and basement. A two car parking pad is located in the rear yard. Code only allows a one car outdoor parking area with screening toward the neighbors. The applicant proposes a fence and evergreen bushes to screen the parking pad. The applicant is removing 26 trees and only planting 17 new trees on this wooded lot. Code requires all 26 trees be replaced. Another 34 trees are being retained in the rear yard. All other location and setback requirements are code conforming. Site plan review is required for all new houses.
#1975 GREATER CLEVELAND REGIONAL TRANSIT AUTHORITY FARNSLEIGH ROAD BLUE LINE RAPID TRANSIT STATION :

Public Hearing on the request of Brian Temming, GCRTA, to the City Planning Commission, for review of improvements to public land for the re-construction of the Farnsleigh Road RTA station. The applicant proposes to add a handicap accessible ramp and modify the platform design, shelters, signage and landscaping in order to meet ADA accessibility standards. A shelter is proposed over the handicap accessibility ramp that matches the other proposed shelter. The adjacent GCRTA parking area on Van Aken Boulevard will be resurfaced in concrete. The City Planning Commission reviews improvements to public land. Council action is required.
CITY OF SHAKER HEIGHTS VAN AKEN DISTRICT PUBLIC ART ACTION STRATEGY:

Public Hearing on the request of the City of Shaker Heights, to the City Planning Commission, for review and adoption of the Van Aken District Public Art Action Strategy. The City has prepared a plan for a detailed and actionable strategy for public art in the Van Aken District. The input has been organized into a set of guiding principles that will give shape to public art installations throughout the district. The plan was prepared during a public process including stakeholder and public meetings, walking tours and a survey in 2017. The City Planning Commission reviews City plans and studies and makes a recommendation to Council on adoption.
